Official Contest Rules
1. Organiser of the Contest. Stampin’ Up! UK Limited (the “Sponsor”) is the organiser of the Stampin’ Summer 2009 - UK Contest (the “Contest”).
2. Eligible Participants; Categories. This Contest is open to residents of the UK aged 18 and over, except employees of the Sponsor and their immediate families. Prizes will be awarded in two prize categories: “Demonstrator” - for all registered Stampin’ Up! Demonstrators; and “Non-Demonstrator” - for all other eligible entrants.
3. Contest Theme; Judging. The theme of the Contest is “My Summer 2009.” Let the season inspire you to craft a unique and original project featuring or interpreting your Summer 2009. Your project will be judged on excellence of content, interpretation of the theme, skillful use of technique, use of Stampin’ Up! products from the current UK Idea Book & Catalogue 2008-2009, creativity, and innovation. Winners will be selected on September 8, 2009, by a panel of qualified judges composed of the three members of Stampin’ Up! Europe’s Management Team and its Training Manager. The decision of the judges is final. The full names of judges will be made available on request.
4. Prizes. A total of four (4) prizes will be awarded, as follows:
Demonstrator First Place: One (1) qualified Demonstrator entrant will be judged the Demonstrator winner and will receive one prize package consisting of Stampin’ Up! stamp sets with an estimated value of £150 (inc. VAT).
Non-Demonstrator First Place: One (1) qualified Non-Demonstrator entrant will be judged the Non-Demonstrator winner and will receive one prize package consisting of Stampin’ Up! stamp sets with an estimated value of £150 (inc. VAT).
Non-Demonstrator Runners-Up: Two (2) qualified Non-Demonstrator entrants will be judged Non-Demonstrator Runners-Up and each will receive one prize package consisting of Stampin’ Up! stamp sets with an estimated value of £50 (inc. VAT).
5. How to Enter. Post your original project to Stampin’ Up! UK Limited, Aston Court, Kingsmead Business Park, Frederick Place, High Wycombe, Bucks HP11 1LA. Your entry must include your name, postal address, telephone number and, if you are a Stampin’ Up! Demonstrator, Demonstrator ID number. Include a list of current Stampin’ Up! products used in creating your project. Sponsor will not acknowledge receipt of entries, and entries will not be returned.
6. Eligible Entries. To be eligible to win a prize, entries must comply with the following terms and conditions:
a. Projects must have been created on or after July 1, 2009.
b. Projects must be created utilising Stampin’ Up! products from the current UK Idea Book & Catalogue 2008-2009, a list of which must be provided with the entry.
c. Entries must be received by Stampin’ Up! UK Limited by close of business on August 30, 2009.
d. Only one entry per person will be accepted.
e. You are responsible for all costs related to entering the Contest, including postage fees, design creation, materials, etc. Sponsor shall not reimburse any costs whatsoever related to the Contest.
f. Any graphics, artwork or other content in your project may not have been previously published or won any other prize/award, must be your exclusive original work, may not be inappropriate or offensive, as determined by the Sponsor in its sole discretion, and may not defame or invade publicity rights or privacy of any person’s personal or property rights or any other third party rights.
g. There is no cost to enter or win and no purchase is necessary to enter or win. This Contest is void where prohibited by law, and is subject to all applicable federal, state and local laws.
7. Contest Period. The Contest commences July 1, 2009 and continues until August 30, 2009 (the “Deadline”). All entries must be received by the Deadline to be eligible to win a prize. The Sponsor may extend all relevant dates if supervening circumstances cause insufficient entries to have been received (in the Sponsor's absolute discretion).
8. Winner Notification; Awarding of Prizes. Prizewinners will be notified by phone, by post, or email on or about September 15, 2009 (unless the contest period is extended). To claim a prize, winners should follow the instructions contained in their notification, on or before October 1, 2009. Prizes will be delivered by post or commercial courier service. All taxes associated with prizes are the sole responsibility of the winner. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. All prizes are awarded “AS IS.”
9. Sponsor Use of Entries. All entries and materials you submit to Sponsor in connection with the Contest (collectively, "Entry Materials"), along with all copyright, trademark and other proprietary rights associated therewith, become the property of Sponsor upon submission, including the right to use your name, biographical information, and likeness (if requested by Sponsor) for all legitimate business purposes including advertising and promotional activities, without additional compensation, unless prohibited by law. You acknowledge that Sponsor has the right to use, reproduce, publish, display, distribute, make derivative works of and otherwise commercially exploit the Entry Materials, without separate compensation to you or any other person or entity. You agree to take, at Sponsor's expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Sponsor to effect, perfect or confirm Sponsor's rights as set forth above in this paragraph.
10. Property Rights. You guarantee that your project is your exclusive original work and that you are the exclusive owner of the intellectual property rights in all the elements of your entry, including the designs, visuals, texts, and images (the "IPR"). You guarantee that you have not granted any right in the IPRs to a third party, in whole or in part, including by any way of assignment, transfer, licence or security. You commit to the fact that any entry you submit does not violate in any way the rights of any third party, including intellectual property rights, publicity rights and/or privacy rights, and guarantee the Sponsor against any plea or claim to this effect. You represent and warrant that any submitted photograph is an original, non-published work that does not infringe the rights of any third parties.
11. Applicable Law; Acceptance of Contest Rules. This Contest and all matters related thereto shall be governed exclusively by the laws of the UK. By entering this Contest, you accept the conditions stated in these Official Rules, as updated from time to time, and to their interpretation under the laws of the UK and by the courts of the UK, and you agree to be bound by the decisions of the judges and warrant that you are eligible to participate in this Contest. If any provision of these rules is invalid under the laws, rules or regulations of the UK, such provision will only apply to the extent permitted.
12. Disclaimer. Sponsor is not responsible for late, lost, stolen, damaged, misaddressed, or misdirected entries or communication.
13. General Release. By entering the Contest, you release Sponsor and any of its parent companies, affiliates, directors, officers, employees and agencies from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory, to the extent permitted by law. You agree that no claims, judgments, or awards shall exceed the amount of the Contest prize and under no circumstances shall include solicitor’s fees, and that you will not be permitted to obtain awards for punitive, incidental, consequential, or other similar damages or have any damage awards multiplied or increased for any reason.
14. Modification or Cancelation of Contest. Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Contest at any time.
15. Collection of Personal Information. In administering this competition, Sponsor may collect personal information from you and, unless it has first obtained consent, Sponsor (i) will not collect more personal information than it needs for the purpose of administering and analysing this promotion, (ii) will only use the personal information for that purpose, which may include transferring personal information to its parent company, and (iii) will not transfer personal information outside the European Economic Community. Any enquiries about personal information should be submitted in writing and sent by pre-paid post to the Sponsor’s address stated below marked “Data Protection Request”. By entering this Contest, you authorise the collection of the required personal information. In the event that Sponsor becomes aware that you are under the age of majority in your country of citizenship, Sponsor will delete, erase or destroy any and all personally identifiable information that is obtained from you.
16. Data Protection. For purposes of clarification pursuant to section 15, personal information collected by the Sponsor from entrants will only be used for the purpose of administering this Contest. The Sponsor will not sell, share or otherwise disclose information collected in any manner with third parties, other than those parties necessary to fulfill the above purposes, unless you have given your prior express consent to receive additional information from Sponsor or a third party.
17. You are deemed to have accepted all the foregoing terms and conditions by participating in this Contest.
